Pretrial Phase Continues in Would-Be Campbell Operator's Rape Case

Next court hearing for popular San Jose nightclub operator Gholam "Ray" Shafazand scheduled for June 21.

The , charged with one count of forcible rape from an incident that supposedly occurred at his Los Gatos home, is in a pretrial stage and waiting for more discovery, the prosecutor in charge of the proceedings said this week.

There have been no hearings scheduled, but Shafazand's next court appearance is at 9:30 a.m., June 21, in Department 23 of the Santa Clara County Superior Court.

"We're in a bit of a holding pattern," said Santa Clara County Deputy District Attorney Luis Ramos, adding that the prosecution and the defense are conducting tests and gathering as much information about the case before a preliminary hearing.

Shafazand is accused of raping a woman, whom Ramos said is not a minor, at his Deer Park Road home in Los Gatos on either Jan. 7-8 following an evening at the San Jose nightclub the Myth Taverna & Lounge.

The defendant appeared the morning of May 3 before Santa Clara County Superior Court Judge Jerome Nadler. He was accompanied by his attorney Anthony Pagkas, who has not returned several phone calls and emails seeking comment.

Shafazand, 50, is facing one count of rape by force, violence, duress or fear, Ramos said, adding that Los Gatos-Monte Sereno police arrested the popular nightclub operator Jan. 8 at his residence.

He was arraigned Jan. 24 and released on $100,000 bail. If found guilty, he faces a maximum sentence of eight years in state prison.

Shafazand, who also owns the Sabor Tapas Bar & Lounge nightclub in San Jose, had been in the Gaslighter Theater, but the on Jan. 3 that would have allowed the business to serve alcohol past midnight.

He had previously been denied the permit on Oct. 25 by the Campbell Planning Commission due to that prohibits downtown businesses from serving alcohol past midnight.

Until we find a way to help these people in need, the camps will just move to another location, and everything will start all over again. The homeless need help - whether they want it or not. He owned and ran that bike shop up until his death in 1975. Subsequent to grandpa's death the house/building became the property of my grandmother, Lucille Faber. Upon her death, the property went to my mother, Jackie Faber-Cornick. In 1978, the business, not the building was sold to Alex Lariviere and he has conducted business since. The building was never sold and belongs to my mom, Jackie Cornick. It was her great-grandparents home back in the 1920's. We are shocked and saddened by this tremendous loss. At this time, we are trying to decide the fate of that beloved building. We are currently awaiting forensics tests, engineering and structural reports, and working with the City to keep it safe and prevent it from being vandalized and becoming a blight. I'm happy to answer any questions you might have about the history of Faber's Cyclery. My grandfather was a man of character and integrity. Sadly, neither of his two sons became involved in the business. With that said, anybody claiming to be a Faber or son of Albert Jacob, is just misrepresenting the truth.
