DA Anticipates Rental Fraud Suspects to Plead Guilty

The two suspects allegedly defrauded up to seven people in Campbell, Morgan Hill and San Jose since 2008.

Defendants in agreed to plead guilty Jan. 9 if the "right offer" was made.

Timothy August and Monica Perretta were arrested on Dec. 14 and charged with multiple counts of theft by false pretenses and passing bad checks.

After investigating, the District Attorneys Office found four victims--landlords--and one sub-lessee.

"We are finishing our investigation on at least one more defrauded landlord (making it five total landlord-victims) and possibly two more sub-lessees (making it three total sub-lessee/victims)," said Santa Clara County Deputy District Attorney Victor Chen. "After all is said and done, I anticipate 16 felony charges will be lodged against Timothy August and 15 felonies (plus one misdemeanor) against Monica Perretta.

"In that instance, they would both be looking at maximum prison sentences of approximately nine years apiece," Chen said.

Since 2008, the two suspects have been allegedly swindling landlords in Campbell, San Jose and Morgan Hill out of rent; nearly $30,000.

August and Perretta will appear in court Jan. 23 for another judge to informally hear the facts and see if resolution, including restitution of between $40,000 and $50,000 can be reached, Chen said.

"For now, it looks like the case will settle within the next few weeks," he said. "If not, it'll be on to a preliminary hearing where witnesses will be called to testify and after that, possibly a jury trial."

I am impressed with CalTrans ability to do the cleanup, but the problem of homelessness does not goRead More away. Until we find a way to help these people in need, the camps will just move to another location, and everything will start all over again. The homeless need help - whether they want it or not. It's time to get that ball rolling.

Who is Tony Faber? Here is some history from a family member. My name is Karen Hunt and myRead More grandfather is and was Albert Jacob Faber. He owned and ran that bike shop up until his death in 1975. Subsequent to grandpa's death the house/building became the property of my grandmother, Lucille Faber. Upon her death, the property went to my mother, Jackie Faber-Cornick. In 1978, the business, not the building was sold to Alex Lariviere and he has conducted business since. The building was never sold and belongs to my mom, Jackie Cornick. It was her great-grandparents home back in the 1920's. We are shocked and saddened by this tremendous loss. At this time, we are trying to decide the fate of that beloved building. We are currently awaiting forensics tests, engineering and structural reports, and working with the City to keep it safe and prevent it from being vandalized and becoming a blight. I'm happy to answer any questions you might have about the history of Faber's Cyclery. My grandfather was a man of character and integrity. Sadly, neither of his two sons became involved in the business. With that said, anybody claiming to be a Faber or son of Albert Jacob, is just misrepresenting the truth.
