CHP Hands Off San Tomas Bike Fatality Case to DA

Santa Clara resident Stanislaw Wicka, 59, was killed on March 12 when a motorist struck his bicycle.


It's been two months since Stanislaw Wicka, 59, from Santa Clara was riding his bicycle along the shoulder of San Tomas Expressway on March 12, just as he had several times in the past. 
According to California Highway Patrol, Wicka was struck and killed by a Gold Toyota Camry, driven by a 20-year-old Melanie Souza of San Jose.
A witness saw the accident and followed the driver of the gold Toyota Camery when she did not stop, said CHP spokesman D.J. Sarabia in February. The witness followed Souza to the Peets Coffee on Union and Camden avenues.
The suspect called her dad from the coffee shop, Sarabia said. Her dad then picked her up from Peets and drove her back to the scene, where she was detained for felony hit and run.
Alcohol was not a factor in this case, said CHP spokesman Chris Falkowski.
From the CHPs perspective, the investigation has been completed on their end and the department has passed the case onto the Santa Clara County District Attorney's office.
"They will decide how to proceed," Falkowski said.

Since 2008, there have been nine collisions along San Tomas Expressway involving bicyclists, Sarabia said. Only one was fatal.
