LETTER: Family of Hit-and-Run Victim Looks for Answers

About two weeks ago, in the early morning hours of December 22, 2012, our brother was killed by a hit and run on San Tomas Expressway in Campbell. His name is Jacksen Dakota Kjeld Madsen and he was 24 years old.

That evening, our family was visited by the officer/detective assigned to the case. The officer was from the CHP, however, it was the Campbell Police Department who was on scene and who wrote up the police report. The officer assured us that he would do everything in his power to find the person who killed my little brother. He said they would contact ALL body shops in the area because broken headlight glass at the scene pointed to a white GMC truck.

After one week of waiting by the phone we hadn’t heard a thing. The officer did not even have the decency to call my mom and update her regarding the slightest detail. A week of sleepless nights wondering ever kind of thing that could have happened and NO call.

Now it has been two weeks, we had a funeral service for my brother, and still nothing. This was a hit and run! Someone who killed our brother is out there and time is ticking away. Our mother (grieving beyond imaginable) called the officer again a few days ago asking if there had been any word from any of the body shops and he had the audacity to tell her he never said they would contact the body shops.

Our father set out on his own investigation and found that not only did ZERO body shops get contacted, but not one officer questioned a single person from "The Spot" in downtown Campbell, which is the last place our brother was seen. The police are telling us it was a hit and run, but who knows if that is even true. They said there were no skid-marks at the crime scene, our mom and dad saw them with our own eyes. Also, if you know you are in search of a white GMC truck, wouldn't you alert body shops to be on the lookout!!????

We just don't understand why the police (the people who are supposed to protect and help us) are being so horrible. They are leaving it upon the grieving family to find out for themselves. I am an educated woman and I KNOW for a fact that justice is not being served to my family and I, and definitely not to my little brother. We will not continue to sit and watch our parents cry relentlessly because they doesn't know what happened. We deserves to know. If anything, they deserve a phone call and an update every few days.

Please, we beg you, as big sisters and daughters wanting peace for their parents, if there is anything you can do to help our family we would be forever grateful. We want to get the word out (news coverage at least!!) about this story so we can try to find who did this.

Also, we haven’t heard one word from Campbell police, the ones who were the first on scene and found my brother dead, and the ones who wrote up the report ... WHY?! We want answers!

This is just awful. My heart goes out to this family, and I hope the police start doing their job! Can you post a copy of the police report? It sounds like you should talk to a lawyer and go higher up in the Campbell and CHP. Keep making a lot of noise about this!

Such a sad story! This could be any one of our sons. Let's hope someone who knows something has a conscience and comes forward. My son and I see the memorial on Budd and San Tomas Expressway everyday I take him to school. Such a heartfelt scene. God Bless you and your family and I hope you get the answers you are looking for.

I feel so badly for this family for their devastating loss. I really do hope they catch who did this and that the family gets the answers they seek. It is just heartbreaking!

I am really disappointed with the Campbell Police Department's involvement in this case. How very SAD, to promise this grieving family that they would take the investigation seriously and contact The Spot and every body shop to try and get answers regarding this death, and not do a thing! Don't the investigators know that the first 48 hours are CRUCIAL in these types of cases! Horrible!!

Lori- San Tomas Expressway is in the jurisdiction of CHP. I agree with the Madsen sisters that their case appears to have been mishandled by the CHP detective that was assigned to it, but this is certainly not an appropriate occasion to attack the Campbell police officers who put their lives on the line every day to protect us.

Crystal, the California Highway Patrol are responsible for the mishandling of this case, not the Campbell police department- it was a CHP detective that was assigned to this case because San Tomas Expressway is CHP jurisdiction.\

Just for clarification, the Campbell PD received the call and were the first to arrive on scene but "Because the expressway is under the CHP's jurisdiction, they are handling the investigation," Campbell Police Capt. Dave Carmichael said.

Thank you, everyone, for your thoughts and prayers. I'm Jacksen's oldest sister. Campbell police is not the ones handling the case, instead, its CHP, like the captain said. However, we only found this out today when somone from Campbell FINALLY called my mom to tell her they were not the ones handling the investigation. A simple call two weeks ago to tell us that, and offer condolences,.would have gotten us off their back. And it still seems the Campbell D know some things thy the investigators from CHP don't. Again, we are left in the dark whether they know this information becuase they have yet to contact us on their own. Excuse me for wanting to find.out what happened to my brother. My family is not the type to ait around and wait to see what happens. We will seek out our own information aa much as we need to. Hence why we have gotten articles in the newspaper and a story on the news (tonight NBC 11) before the chp has. I can't sleep, I can't function fully at work until I feel I've done my part. Thanks again for all the support and anyone who is getting the word out.

My son, Christian, went to elementary and middle school with Jacksen, attended his memorial services (which includes the unsanctioned one at Budd/San Tomas Expressway :-) ) and has grieved for your son since he heard of it. I can help spread the word; and please know, that outside of his immediate family, your son is missed. LET THE NOISE BEGIN!!!

I am so terribly sorry for your loss and sorry also that the "system" has failed to support your family and provide you with some answers. I live in Campbell and have also posted your letter on my FB page. I will pray that you find some answers and some closer for this terrible tragedy. Godspeed.

This story JUST aired on the NBC 5 o'clock news so hopefully it will now get the attention it deserves and your family can get some answers (& if not, I would strongly urge that you contact an attorney). I will continue to say prayers for you and your family.

Hang in there, Amber. The story tonight on NBC will only help in moving this along and finding more answers, witnesses, etc. The delays and feet dragging are unacceptable. Lost time. With all the cameras and surveillance technology currently deployed by homeowners and businesses I would hope the PD knocked some doors in the neighborhood and nearby cross streets in their investigation. My heartfelt condolences to you and your family.

I am so very sorry. My heart goes out to you and your family. I'm hoping and praying that you guys get some answers. My daughters are friends with Paige, from way back, and my daughter's boyfriend is heartbroken over losing his dear friend. They were all at Jacksen's service. I shared this article and also your Mom's post on Facebook (and sent it to Channel 2 which last night broadcast a hit and run in SF that injured a teen girl, looking for witnesses. I asked that they please do a segment regarding Jacksen) I will keep posting to try and help get the word out. I can't imagine the pain your family is going through and to find out that the law enforcement agencies seem to "not care" is just horrible. My heart hurts for your family, and I pray that you will be able to find some peace.

Living in "Middle America", but seeing this happen, breaks my HEART! Best wishes, and Prayers for the Madsen family! May you finally find out WHO is responsible for the death of your brother/son, in this hit and run, and May God BLESS your family! SO saddened, to read this! People doing their "JOB", I believe, could have alleviated so much angst and heartache, for a family already suffering! Does ANYONE do their job, the way they should, anymore???

I think it's a mistake by making this story more public than it should... Now the suspect will know to avoid body shops and would probably go under hiding more than he/she has now that the entire community is looking for him. There was probably a reason the police kept things in the dark... for reasons such as this. Honestly, this may have just jeopardized the case more than anything. However, I am sorry for the loss and I hope that they do catch this person.

Sometimes you have no choice but to make things public. Sometimes that is only way anyone helps you. It is unfortunate, but I hope doing this helps the family get answers. If it was your loved one you would want answers and I am sure if you felt no one was doing anything you would do what you felt was necessary.
To the family: if you are seeking the answers yourself by calling body shops do not rule out that the person could repair things on their own. Check with dealerships and auto part stores to see if the parts needed for the repair have been ordered by anyone. I hope you find answers and get the justice your brother so deserves.

Whether its CHP or Campbell PD their should be someone who keeps the family updated on what's going on. I truly hope justice is served. No one deserves to be put through this. My heart goes out to this family, I see it everyday taking my son to school and it breaks my heart. My thoughts and prayers are with the family. I hope and pray you find the person and answers you need

The only reason we as a family felt we had to get the word out was for the pure fact that we were being told NOTHING! A phone call to our family saying " we know ita hard to wait, however putting any press out at this time will jeoprodize things, so please be patient." Simple. Ita called communication. Instead, we are left in the dark for 2.5 weeks. We went with our gut to try and get word out. Someone knows something. Thanks, all.

They should be able to find out who the driver was through street cameras.Those things are everywhere.We will be praying for your family and the capture of the assailant. Last year man was killed on Winchester Blvd. in front of Autohaus Los Gatos.Campbell PD caught the driver on video. I did not hear about it for weeks after it's probably all the investigation that has to happen first before they say anything.

I live at LaValencia Apartment complex and my unit faces Budd, with a clear view of that intersection. I am usually easily awakened by any tires screeting or honking and was not awakend until well after the incident. I was surprised and saddened to hear what had happened, and saddened more to see the memorial completely removed on Friday. I had grown used to seeing the lit candles, many flowers, balloons and frequest visitors, some who sat for hours in the cold. My heart goes out to his many friends and family. I wish I had seen or heard something useful.

Hi Renae! By chance, does your appartment complex have video cameras that possibly face the street? Probably not a question for you, but your complex. I can try to call. Possibly he was walking and could have been caught on camera. Thanks!
